    ❗️Israeli Knesset approves public trials & death penalty for 7 October detainees allegedly involved in Al-Aqsa Flood

    Israel’s Knesset voted 93–0 to approve legislation establishing a special tribunal empowered to try Palestinians accused of involvement in the 7 October 2023 Operation Al-Aqsa Flood. The bill allows public “show trials,” including the filming and broadcast of hearings, verdicts, and sentencing on a dedicated website, and makes the death penalty easier to impose.

    Rights groups including Adalah, Hamoked, and the Public Committee Against Torture in Israel warn that the law strips away basic fair trial protections, permits broader use of evidence obtained under coercive conditions that may amount to torture, and effectively treats indictment as proof of guilt, as cited by Al Jazeera.

    An estimated 200 to 300 Palestinians abducted by Israel during Operation Al-Aqsa Flood remain imprisoned without charge.

    The legislation is separate from a March law introducing death by hanging for Palestinians convicted of killing Israelis.

      ❗️Statement by Hamas:

      “The Zionist Knesset’s fascists and racist ‘legislation,’ which imposes the death penalty on our Palestinian people’s prisoners—particularly whom the occupation accuses of participating in the Al-Aqsa Flood battle—represents a dangerous escalation and a new crime added to the occupation’s long record of war crimes and systematic violations against our Palestinian people. We affirm that this ‘law’ is null and illegitimate, and flagrantly violates all international laws and conventions, especially the Geneva Conventions and international humanitarian law.

      What this legislation includes of exceptional powers granted to the military courts, such as allowing to circumvent the rules of procedure and evidence and setting arrangements for executing the death sentences, reveal the revenge-based and racist nature of the occupation regime, as it also highlights the fascist occupation government’s endeavor to legitimize the killing of Palestinian prisoners and turning the courts into means of revenge and punishment, far from any standards of justice or fair trials.

      This legislation also reflects the occupation’s attempts to evade any path for future prisoner exchange deals by explicitly excluding the Al-Aqsa Flood [battle] prisoners from any potential deals, in a stark violation of international humanitarian law and all humanitarian norms.

      We warn of the serious repercussions of this racist law and affirm that the policy of terror and fascist legislation will not break the will of our people or stop their legitimate struggle for their full national rights.

      We call upon the UN, the International Criminal Court (ICC), the Human Rights Council, and all international rights and humanitarian groups to assume their legal and moral responsibilities, to act urgently to stop and annul this criminal legislation, to hold the occupation’s leaders accountable for their ongoing crimes against the Palestinian prisoners, and to provide them with international protection as freedom fighters resisting a racist colonial occupation condemned by international laws and conventions. We stress that the international community’s silence regarding such racist policies only emboldenes the occupation’s government to continue its crimes and violations.”
